§ 1 INTRODUCTION
1.1 Bawialnia Milimali located at Letnicka Street 2, loc. 6, 80-536 Gdańsk (hereinafter: "Milimali") is a play space, intended for both children and adults, within which function:
a. Toddler Zone.
b. Fun Zone.
c. Catering area.
d. Public areas, including reception area.
1.2 The entity responsible for and operating Milimali is a company under the name of Funlandia spółka z ograniczoną odpowiedzialnością seated in Jarnołtówek 19A, 48-267 Jarnołtówek, entered in the register of entrepreneurs of the National Court Register kept by the District Court in Opole, VIII Economic Department of the National Court Register, under KRS number: 0001061045, REGON: 388949500, NIP: 7532460680 (hereinafter referred to as the "Company").


§ 2 GENERAL PROVISIONS
2.1 The Rules and Regulations regulate the rules applicable to all persons residing in the Milimala area (hereinafter referred to as the
"Customers"), which includes both persons entering into a contract for the provision of services at Milimali with the Company, as well as persons staying on Milimali's premises at the invitation of such persons (e.g., guests of a special event) or under their care (in the case of minors). Whenever reference is made to a Customer who is a minor, the persons responsible for the observance and performance of the obligations under the Terms and Conditions in the given scope shall be the parent, legal guardian or person having custody of the minor using Milimala in accordance with the declaration submitted.
2.2 The Company shall provide the Customers with services which include making the Milimali space available for use in accordance with its purpose, including additional services such as, among others, organization of birthday parties, workshops or special events. The rules of providing additional services may be specified in additional regulations or appendices to the Regulations.
2.3 For security reasons and for the comfort of Customers, the number of people who can use Milimala at the same time is limited. In view of the above, the Company reserves the right to refuse to allow individuals to use Milimala if the established limitations are reached.
2.4 The Company reserves the right to reserve the entire Milimali area or particular parts of it for special events, which means that in a given range the use of Milimali may not be possible. Information about such restrictions is visible at the reception desk of Milimala. If the Client uses Milimali in spite of the information about restrictions, the Client is not entitled to a refund of part or all of the fee paid.
2.5 The Company reserves the right to completely disable the use of specific attractions in case it is necessary, in particular, if they break down or require maintenance or repair.
2.6 In the case of unscheduled shutdown of specific attractions in the event of fortuitous events (e.g., breakdowns, accidents) or for safety reasons, the customer on this account is not entitled to a refund of part or all of the fee paid. Individual cases in this regard will be resolved by complaint in accordance with the provisions of the Regulations.
2.7 It is forbidden to place any advertisements, notices or other such materials on Milimala's premises without the prior consent of Milimala's employees (hereinafter: "Personnel") or the Company.
2.8 The Customer is obliged to immediately report to the Personnel:
a. any accidents,
b. noticed malfunctions or problems with the functioning of Milimali equipment,
c. any violations of the Rules,
d. dangerous, inappropriate or improper behavior of other Customers.

§ 3 RULES FOR THE USE OF MILIMALS
3.1 The person using Milimali is obliged to use Milimali equipment properly, in accordance with the purpose of the item of equipment and the instructions for its use.
3.2 The person using Milimali is obliged to comply with the instructions of the Personnel, which may be given, in particular, with regard to safety and the manner of using Milimali. The instructions of the Personnel may concern, in particular, changing the way of using Milimali, leaving specific places, as well as abandoning certain activities.
3.3 A person using Milimali should be in clothing that allows unhindered and safe play, without loose parts or those that can get stuck or damaged while using Milimali, without jewelry and watches. Clothing pockets should be emptied when using Milimala. If not required for safe play, it is recommended to use Milimali without glasses.
3.4 A person using Milimala is required to have clean socks for a change. It is forbidden to use Milimala in shoes or barefoot. The above does not apply to the catering area, where it is possible to be in footwear provided that special protectors are worn.
3.5 As part of the public area, Milimali provides customers with lockers free of charge, where customers can store outerwear, footwear, bags and other items that are prohibited to be brought into Milimali's premises.
3.6 In exceptional situations, in particular when information or doubts arise as to whether the use of lockers complies with the Regulations, the Staff shall be entitled to open the lockers to check their contents, with the Staff, if possible, first obliging the person using the locker to show its contents.
3.7 Due to the need to ensure the safety of all those using Milimala, the Staff has the right from refusing entry to Milimala or to ask a person to leave Milimala:
a. which has visible symptoms of health problems (runny nose, cough, fever, rash, etc.) Out of concern for the safety of all Users, staying,
b. a person whose condition or behavior clearly indicates being under the influence of alcohol, intoxicants or other similar substances,
c. minors who show aggressive behavior, destroy Milimala's equipment, persistently interfere with the play of other Customers, etc.,
d. a person who violates the provisions of the Regulations.

3.8 The customer is obliged to adequately secure his personal belongings.
3.9 The person using Milimala is obliged to immediately hand over to the Personnel any personal belongings found on the premises of Milimala. The Company will release the found thing to its owner after it is probable that it belongs to the owner. An item left behind after 30 days of its finding shall be treated as an item that the owner has abandoned with the intent to dispose of the property. In such a situation, the Company has the right to dispose of the item as it pleases, including, in particular, donating it to a charitable organization or persons in need.
3.10. It is forbidden to leave dangerous objects in lockers (in particular, those carrying the risk of fire, explosion, flooding, pollution). Valuables should be left by the Client at home or in another safe place.
3.11. There is an absolute prohibition on the territory of Milimala:
a. bringing or possessing weapons or other dangerous objects,
b. bringing, possessing or consuming or using alcohol, drugs, respectively,
narcotics and others with similar effects,
c. smoking of tobacco products and use of so-called e-cigarettes,
d. to bring in and consume their own food and beverages, with the exception of food and beverages, the consumption of which is necessary due to the Client's age or health condition, with the Client having to inform the Staff of this fact before using Milimala,
e. to bring or possess any items that may cause danger to the life or health of persons residing on Milimala's premises, as well as to property located on Milimala's premises, including materials that are dangerous, harmful to health, with a noxious odor, flammable, explosive, as well as others prohibited by law,
f. use of food and beverages purchased in the food area outside the food area,
g. chewing gum;
h. indecent behavior, use of vulgar and abusive words;
i. introduction of animals, with the exception of support animals (e.g., guide dogs), such situation requiring prior agreement with the Personnel before using Milimala.
3.12. The parent, legal guardian or person who has custody of a minor using Milimali in accordance with the declaration made, is obliged to acquaint the minor with the information contained in the Regulations and the rules of use of Milimali, taking into account the degree of his development and physical and intellectual abilities. The person referred to above is responsible for exercising supervision over the minor using Milimala.
3.13. The use of Milimala by children shall be with the consent and under the sole responsibility of the parent or legal guardian or the person having custody of the minor using Milimala in accordance with the submitted statement.
3.14. The Toddler Zone is designed for children aged 0 to 3 years.
3.15. the Fun Zone is intended for children from 0 to 8 years of age (children who are under 8 years of age
life).

3.16. Children under 3 years of age may use Milimali attractions only under the supervision of a parent, legal guardian or person having custody of a minor using Milimali in accordance with the declaration submitted.
3.17. Children who are at least 3 years old may also use Milimali attractions independently. Independent use of Milimali attractions requires that the parent, legal guardian or person having custody of the minor using Milimali in accordance with the affidavit be given prior written consent in accordance with the form provided by the Staff. Under the conditions referred to above, independent use of Milimali attractions shall be under the sole responsibility of the parent, legal guardian or person having custody of the minor using Milimali in accordance with the affidavit submitted.
3.18 Staff shall be entitled to verify the age of the child, in particular, if there are doubts about the veracity of the statement made in this regard by the Client.


§ 4 PAYMENTS - TICKETS AND PASSES

4.1 The use of Milimali is subject to payment. The amount of fees for the use of Milimali is specified in the price list of services provided at Milimali (hereinafter: "Price List"), made available at the reception desk of Milimali and on the website at: www.milimaligdansk.pl.
4.2 The sale of tickets entitling to use Milimala is conducted stationary and online on the website at: www.milimaligdansk.pl.
4.3 The ticket is recorded on an electronic card (hereinafter: "Card"). The Card constitutes an access card specifying the time of stay at Milimala.
4.4 The length of stay is calculated from the time the Customer purchases the ticket until the Card is returned to the Staff.
4.5 In the case of purchase of a ticket for a minor, the right to free entrance to the Milimala premises shall be acquired by one adult who is a parent, legal guardian or person having custody of a minor using Milimala in accordance with the submitted statement.
4.6 In the event of unused ticket, as well as unused paid time, the customer on this account is not entitled to a refund of part or all of the fee paid.
4.7 It is possible to purchase passes entitling to multiple entry to the Milimala premises (hereinafter: "Pass"). The fee for issuing the Passes is determined in accordance with the Price List.
4.8 Passes are registered and valid for the number of days specified on the Pass starting from the date of purchase.
4.9 If the Pass is not used in part or in full, the Customer is not entitled to a refund of part or all of the fee paid.
4.10. In case of exceeding the time of stay in Milimali as stipulated in the ticket, each additional minute will be charged in the amount specified in the Price List, which the Customer is obliged to pay.
4.11 The Company shall provide the possibility of issuing an invoice. If you intend to make a transaction in connection with your business activity and have the intention to receive an invoice, it is necessary to indicate the provision of a VAT number when placing and paying for the order. Otherwise, it will not be possible to generate an invoice containing the purchaser's TIN number after the transaction is completed. A transaction made by a non-business individual, or without providing a TIN number when placing and paying for an order, will be able to be

documented by an invoice that does not contain the buyer's TIN number at the buyer's request submitted within 3 months, counting from the end of the month in which the transaction was made.


§ 5 RESPONSIBILITY
5.1 The use of Milimala involves the risk of injury and damage to property. The Company is not liable for injuries and damage to property resulting from circumstances for which the Company is not liable under general rules. Customers use Milimala's facilities at their own risk, including the responsibility of a parent or guardian in the case of minors.
5.2 For damage and destruction in Milimala, resulting in particular from non-compliance with the Regulations, each Customer is personally liable up to the amount of the actual cost of removing the damage or repairing the damage.
5.3 The Company shall not be responsible for items left in lockers.
5.4 The Company is not responsible for the Client's personal belongings left unattended, lost or damaged on Milimala's premises.
5.5 An additional fee of PLN 60.00 will be charged for loss, damage or destruction of the Card.
5.6 In case of loss of the Pass it is possible to issue a duplicate for a fee of PLN 20.00.
5.7 In case of causing hard-to-remove dirt on the premises of Milimala, the Customer responsible for its creation is obliged to pay a fee of PLN 50.00.
5.8 The Company shall not be liable for interruptions in the operation of Milimala resulting from force majeure or caused by circumstances beyond the Company's control.


§ 6 COMPLAINTS
6.1 Subject to the rights of Customers under generally applicable laws, all complaints about services provided in Milimali should be reported by Customers, if possible, within 14 days from the date of service in Milimali in order to allow collection of the necessary information to consider the complaint.
6.2 The complaint shall be submitted by the Client in writing at the reception desk of Milimali or electronically to the e-mail address biuro@milimaligdansk.pl, or by regular mail to the Company's registered address.
6.3 The complaint shall include:
a. Customer's name,
b. Customer's contact information (Customer's e-mail address and/or Customer's telephone number and/or Customer's mailing address),
c. date of service and type of service,
d. description of the situation that the customer is advertising,
e. Customer's request.
6.4 If the complaint does not contain sufficient information for its consideration, the Company has the right to call on the Customer to supplement it, under pain of leaving the complaint unprocessed.

6.5 The Company shall consider complaints within 14 days of their receipt by providing the Customer with an appropriate response by registered mail or e-mail, depending on the form of transmission of the complaint by the Customer and the method of further communication on the complaint indicated by the Customer.
6.6 The services provided in Milimali have a designated day of provision and relate to services related to leisure, entertainment, sports or cultural events, so in accordance with the provision of Article 38 (1) (12) of the Act of May 30, 2014 on Consumer Rights (i.e. Journal of Laws of 2023, item 2759, as amended), Customers do not have the right to withdraw from the contract referred to in the provision of Article 27 (1) of the said Act.


§ 7 PROTECTION OF PERSONAL DATA

7.1 The Administrator of the personal data provided and processed in connection with the provision of services in Milimali is Funlandia spółka z ograniczoną odpowiedzialnością seated in Jarnołtówek 19A, 48-267 Jarnołtówek, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Opole, VIII Economic Division of the National Court Register, under KRS number: 0001061045, REGON: 388949500, NIP: 7532460680.
7.2 In all matters related to the processing of personal data, please contact the Company electronically by sending an e-mail to: biuro@funlandia.pl or in writing to the address Jarnołtówek 19A, 48-267 Jarnołtówek.
7.3 The rules for processing personal data (information clause) are presented in Appendix 2 to the Regulations.


§ 8 FINAL PROVISIONS
8.1 The Regulations are effective as of May 30, 2024.
8.2 The content of the Regulations is available on the website www.milimaligdansk.pl, at the reception desk of Milimali and by posting in Milimali.
8.3 Entering the premises of Milimala is tantamount to making a statement that you are familiar with the
with the Rules and Regulations, regulations on additional services and the price list, as well as full acceptance of all provisions contained therein. A person who does not accept the rules of Milimali should leave Milimali immediately.
8.4 The provisions of the Rules and Regulations may be supplemented by the content of other rules and regulations for additional services, in particular for specific services and attractions available through Milimala. In the case of introduction of specific regulations, the provisions of the Regulations shall remain in force and continue to be binding, unless the specific regulations provide otherwise.
8.5 The Company reserves the right to amend the Regulations and specific regulations for important reasons, including, in particular, changes in the law, the implementation of obligations arising from court rulings or administrative decisions, organizational changes, the introduction of new or discontinued services.
8.6 The Company shall give notice of any planned change to the Regulations by posting the new Regulations or specific Regulations in Milimali, as well as by making them available on the website www.milimaligdansk.pl. The aforementioned will take place no later than 7 days prior to the planned changes.
8.7 The Company reserves the right to change the price list. Any changes in the price list shall not affect previously purchased services and concluded contracts. The Company will notify the change of the price list by posting the new price list in Milimali, as well as by making it available on the website www.milimaligdansk.pl.
